The artificial intelligence boom has been accompanied by an upsurge in state legislation aimed at regulating this new technology. As many state legislatures close out their 2024 legislative sessions, the Brennan Center reviewed the trends in the AI-related bills that states introduced and passed so far this year. From January 1 to July 31, 2024, 14 states have enacted new laws or provisions to regulate the use of deepfakes in political communications.
However, there has been remarkably little new policy in a host of other areas related to AI and democracy, from how AI is used in election administration to how it could be used to attack the security of our elections or suppress votes, though states have enacted legislation to address AI discrimination in housing and employment, AI generated child sexual abuse material, and consumer privacy. In this review, we focus particularly on legislation that is directly or indirectly related to AI and elections.
