New York, N.Y. – Today the U.S. Court of Appeals for the Third Circuit affirmed the constitutionality of Delaware’s Elections Disclosure Act, which requires outside groups and individuals to disclose their donors to the public if they publish advertisements or other communications that refer to a candidate in an upcoming election.
“The Court’s ruling to uphold this common sense, clearly constitutional law is a victory for the state’s voters,” said Daniel I. Weiner, senior counsel at the Brennan Center for Justice. “Delaware’s Election Disclosure Act will continue to work toward its intended purpose — maintaining transparent, fair elections. At a time when an explosion of dark money in U.S. elections is leaving more and more voters unaware of who is funding election campaigns, strong disclosure laws can help arm voters with the information they need to hold politicians and their backers accountable.”
The Brennan Center and Weil, Gotshal, and Manges LLP filed a brief in the case, on behalf of Common Cause and the Delaware League of Women Voters.
