On April 29, the Brennan Center submitted a joint comment with EPIC, EFF, Fight for the Future, TechTonic Justice, and UnidosUS in response to OMB’s request for information on “Responsible Procurement of Artificial Intelligence in Government,” (OMB-2024–0004). As federal spending on AI grows, the comment urges OMB to establish procurement guidelines that: (1) increase agency understanding and public awareness of AI systems sold by the private sector; and (2) improve how agencies adapt to rights and safety risks during and after procurement. The comment uses agency acquisition of social media monitoring tools as a case study of how to operationalize these recommendations and increase transparency and accountability in AI procurement.

The federal government is spending billions of dollars on AI contracts. On April 29, the Brennan Center for Justice, the Electronic Privacy Information Center (EPIC), Electronic Frontier Foundation (EFF), Fight for the Future, TechTonic Justice, and UnidosUS jointly submitted a comment to the Office of Management and Budget (OMB), urging OMB to publish guidelines on AI procurement that center people’s rights and safety.
