Legal Protections from Election Subversion and Voter Suppression

Numerous federal and state laws guard against attempts by election deniers to intimidate voters or election workers. Laws also detail what poll workers and election observers can and can’t do.

The election denial movement, fueled by false claims of fraud in 2020, has spurred efforts that are ostensibly to maintain the integrity of elections but in reality threaten to suppress the vote and interfere with proper election administration. Their tactics include attempts to intimidate voters or election workers. They also encompass baseless challenges to voter eligibility, either through mass filings ahead of Election Day or individual challenges at polling places.

Election denier groups have also called on their adherents to sign up to be poll workers or election observers to carry out these actions.

The Brennan Center has created resources detailing the federal and state laws that protect democracy and the right to vote from such efforts, with a focus on the rules in battleground states.
